Calculating Damages for a Civil Lawsuit
A business consortium that included a gaming operator and 15 individual charities filed a civil suit against another gaming operator alleging that the defendant conspired with local law enforcement to withhold a gaming license. Without the license to operate, the plaintiff alleged that monetary damages from lost opportunities over a period of years would be incurred as a direct result of not being allowed to open the planned establishment.
The challenge was to accurately compute reasonable and reliable estimates of economic damages and lost profits in support of the plaintiff’s case, and to articulate those estimates effectively in front of a federal jury.

The firm leveraged financial accounting models, estimates prepared by the plaintiff’s lenders and profit reports from the defendant to create conservative, fact-based assessments of the plaintiff’s losses. The jury found for the plaintiff and awarded the plaintiff more than $44 million in compensatory damages – the amount computed and specified by the Forensic Strategic Solutions team – and $20 million in punitive damages.
